0. Important Notice

PeerLLM is an experimental distributed AI network. By operating a Host, you acknowledge and accept the following:

If you do not accept these risks, do not operate a Host.

1. Independent Participation

You are an independent participant and not an employee, contractor, partner, agent, joint venturer, or representative of BestBytes AI LLC. Nothing in this Agreement creates any employment, partnership, joint venture, agency, fiduciary, or similar relationship between you and BestBytes AI LLC.

2. No Guaranteed Earnings

Participation does not guarantee income. Earnings may be zero. Network demand is unpredictable and controlled by the PeerLLM system. Payments are not guaranteed and may be zero. You acknowledge that operating a Host may result in financial loss.

You acknowledge that you are not relying on PeerLLM as a source of income or financial opportunity.

2.1 No Reliance

You acknowledge that you are not relying on PeerLLM as a source of income, employment, or financial opportunity. Participation is voluntary and speculative.

3. Costs and Hardware Responsibility

You are solely responsible for all costs associated with operating your Host, including hardware, electricity, cooling, internet usage, bandwidth, maintenance, repair, and replacement. BestBytes AI LLC is not liable for hardware damage, degradation, overheating, system instability, service interruptions, or operational costs of any kind.

4. Payments

If payments are enabled, they are discretionary and based on internal usage calculations and platform rules determined by BestBytes AI LLC. Payments may be adjusted, delayed, reduced, withheld, reversed, or revoked at any time, including in cases of suspected abuse, fraud, security risk, policy violation, legal risk, payment processor limitations, or system error.

Payments may be subject to third-party processors and may be delayed, restricted, reversed, or fail due to factors outside the control of BestBytes AI LLC.

You have no ownership claim over user payments, platform revenue, or any funds collected by BestBytes AI LLC. BestBytes AI LLC does not hold funds in trust, escrow, or custody on your behalf.

Any subscription fees, access fees, or host-related charges are separate from earnings and do not guarantee income, traffic, or payout of any kind.

BestBytes AI LLC may modify pricing, payout rates, calculations, eligibility requirements, and economic structure at any time.

Nothing in this Agreement creates any entitlement to revenue sharing, profit sharing, wages, or financial participation in PeerLLM. Payments, if any, are discretionary service-based compensation only.

5. Taxes and Compliance

You are solely responsible for all taxes, reporting obligations, registrations, filings, fees, duties, and legal compliance in your jurisdiction. BestBytes AI LLC may require submission of tax documentation, identity verification, or other compliance documentation before issuing payments, including but not limited to IRS forms or equivalent documentation for non-U.S. persons. Failure to provide requested documentation may result in delayed, reduced, or withheld payments.

6. Data Processing

You may process user prompts, outputs, metadata, or related information transiently as part of network operation. You may not store, log, retain, copy, reuse, disclose, analyze, inspect beyond what is technically necessary, sell, sublicense, or train on this data. You act only as a temporary processor for execution purposes and acquire no rights in any such data.

Hosts do not control, review, originate, or assume responsibility for the prompts or content they process merely by virtue of automated routing. PeerLLM routes requests automatically, and Hosts function only as execution nodes within the network.

You do not acquire any ownership, rights, or claims over user prompts, outputs, or any data processed through the network.

6.1 Public Host Information

PeerLLM operates a publicly accessible view of the network. By operating a Host you agree that we may publish, to anyone and without restriction, information about that machine, including: the display name you choose for it, a short host identifier, device class, processor architecture, operating system family, Host Software version, online or offline status, uptime, latency, cumulative request and token counts, total and in-use memory and accelerator capacity, and the models it holds together with their measured throughput and whether each is currently loaded.

We do not publish your name, email address, account identifiers, payout or billing detail, earnings, IP address, connection identifiers, precise location, or the content of any prompt or output your Host processes.

A Host display name is public and acts as a pseudonym for the machine rather than for you. Unless you set one, it defaults to your computer's own machine name, which on a work or organization-managed computer may identify your employer or you personally. You are responsible for choosing a display name you are willing to have published, and you may change it at any time in the Host Software or through the PeerLLM CLI. Taking a Host offline or removing it from the network ends the publication, although aggregate network totals that do not identify any individual machine may persist.

7. Security

You must take reasonable and appropriate measures to secure your system, credentials, environment, and network against unauthorized access, malware, abuse, interception, and misuse. Failure to maintain reasonable security may result in suspension, termination, blocked payments, or permanent removal from the platform.

BestBytes AI LLC may monitor, test, inspect, simulate traffic, or audit Host behavior at any time to ensure compliance, quality, security, and integrity of the network.

8. Model and License Compliance

You are solely responsible for ensuring that all models, weights, software, dependencies, datasets, and other components you run or expose through PeerLLM are properly licensed and legally usable for your intended use. You are solely responsible for any violations, claims, damages, or obligations arising from your use of such components.

9. Platform Control

The PeerLLM system determines routing, scheduling, prioritization, workload distribution, availability, and related platform behavior in its sole discretion. No guarantees of traffic, priority, fairness, minimum usage, uptime, or continuity are provided.

Hosts may receive zero requests at any time, regardless of availability, performance, or configuration.

10. Remote Management of Your Host

When you run the Host Software and connect it to the network, your Host maintains an outbound connection to the network so that management commands can be delivered to it. What may be done, and by whom, is deliberately limited.

You (the Host Owner) may remotely manage your own Host in full from the Portal, including restarting it, viewing its logs, running test prompts, updating the Host Software, and downloading, loading, unloading, or deleting Approved LLMs on it.

Authorized administrators of BestBytes AI LLC may, only as needed to operate, secure, and maintain the network, remotely: (a) restart or recycle your Host; (b) retrieve your Host's logs, which are handled under the BestBytes AI LLC Privacy Policy and from which the Host Software makes reasonable efforts to redact secrets; (c) run diagnostic test prompts against it; and (d) load an already-downloaded, approved model into your Host's memory. Administrators may NOT update your Host's software, and may NOT download, add, or delete files on your Host — those actions are yours alone. Software updates are applied only by you and are never initiated by administrators.

These actions apply only to the Host Software and the models and logs it manages; they do not grant access to your other files, applications, or personal data. You may stop all remote management at any time by disconnecting or uninstalling the Host Software. Your continued operation of a Host on the network constitutes your consent to the management described in this Section.

11. Acceptable Use

You must not generate illegal content, manipulate routing, falsify capacity, interfere with platform operations, tamper with requests or responses, attempt to intercept data, abuse the payment system, or otherwise misuse PeerLLM.

You must provide complete, meaningful, and non-deceptive outputs. Repeated low-quality, incomplete, or misleading responses may result in reduced routing, withheld payments, or removal from the network.

Violations may result in immediate suspension, permanent removal, forfeiture of payments, referral to payment processors, or referral to law enforcement where appropriate.

12. Experimental Nature

PeerLLM is an experimental system and may change at any time without notice. Features, APIs, payout systems, eligibility rules, host requirements, moderation controls, security controls, routing behavior, and platform economics may be added, removed, paused, or modified at any time. The platform may experience outages, interruptions, degraded performance, or data loss.

13. Disclaimer of Warranties

PeerLLM is provided on an "AS IS" and "AS AVAILABLE" basis, with all faults and without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, security, or uninterrupted operation.

14. Limitation of Liability

To the maximum extent permitted by law, BestBytes AI LLC shall not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for any loss of data, loss of goodwill, hardware damage, business interruption, utility cost, security event, or economic loss arising from or related to your participation in PeerLLM.

To the maximum extent permitted by law, the total aggregate liability of BestBytes AI LLC shall not exceed the greater of (a) one hundred U.S. dollars (US $100), or (b) the total amount actually paid to you during the twelve (12) months preceding the claim.

15. Indemnification

You agree to defend, indemnify, and hold harmless BestBytes AI LLC and its affiliates from any claims arising from your participation, your Host operations, your models, your legal violations, or your breach of this Agreement.

16. Termination

You may stop participating at any time. BestBytes AI LLC may suspend, restrict, block, or terminate your access or Host at any time if necessary to protect the network, enforce policies, comply with legal obligations, or address risk.

17. Dispute Resolution

All disputes shall be resolved exclusively by binding arbitration in King County, Washington, USA. You waive any right to participate in class actions or jury trials.

18. Governing Law

This Agreement is governed by the laws of the State of Washington, USA.

19. Agreement Updates

Agreement updates take effect immediately upon publication. Previously accepted versions may be invalidated. Continued operation requires acceptance of the latest version.

When a new version is published, PeerLLM may prevent your Host from serving network requests until it is accepted. While acceptance is outstanding, your Host may not be assigned work and may not accrue earnings for that period.

19.1 No Liability for Earnings Lost While an Update Is Unaccepted

You acknowledge that a period of non-acceptance may result in reduced or zero earnings, and that BestBytes AI LLC is not liable for any earnings, opportunity, or other loss arising from a Host being unable to serve while a new version of this Agreement awaits your acceptance. Reviewing and accepting updates promptly is your responsibility. Acceptance is recorded against your account rather than against an individual machine, so accepting once covers every Host you operate. Nothing in this Section limits Sections 2 and 2.1, under which no earnings are guaranteed in any event.

20. Entire Agreement

This Agreement, together with the Terms of Service and Privacy Policy, constitutes the entire agreement.

21. Acknowledgment

By accepting this Agreement, you confirm that you have read, understood, and voluntarily agree to all terms and risks.
